A man in Las Cruces was killed after being run over by his fiancée in a pickup truck. The two allegedly got into an argument and he exited the vehicle. It is reported that his fiancée then ran over him with the truck and he died a few hours later at Las Cruces hospital. He was a father of three children as well as a former marine and firefighter.
Though his fiancée was charged criminally, she was only convicted of involuntary manslaughter and is now out on parole. Now, his family is filing a civil wrongful death suit against his fiancée alleging that she was negligent and solely at fault for causing her fiancee’s death.
His family is seeking damages for his personal injuries, as well as pain and suffering, loss of enjoyment of life and punitive damages.
Wrongful Death and Other Personal Injury Claims
Wrongful death claims can be complicated because they encompass more than simply the death of an individual. If successful, a family can be compensated for their loved one’s personal injuries in addition to other damages including but not limited to:
- Loss of enjoyment of life
- Pain and suffering
- Future Income
- Medical Bills
- Punitive Damages
While these damages can never bring a loved one back, it can help to ease the financial burden that often results from a wrongful death. If the deceased individual is a caretaker for others, then the damages are likely higher. At the same time, if the deceased is a child, then there is a lot of room for collecting damages based on what they would have done with their life in the future.
Why Bring a Wrongful Death Claim
In addition to recovering monetary damages, wrongful death claims are important to draw the community’s attention to important issues that may affect them. Additionally, wrongful death actions can be helpful for emotionally recovering form the devastating loss of a loved one.
